Some people who belong to certain categories, in all societies, suffer from some obstacles that prevent them from leading a normal life, unlike normal people. Such people are called “Persons with Disabilities”, according to what the majority of comparative laws have settled on, including the current Jordanian law on the Rights of Persons with Disabilities No. 20 of 2017 and the Convention on the Rights of Persons with Disabilities of 2006. The majority of countries across the world have exerteda great deal of efforts in attempting to remove such obstacles represented in several legislations and decisions, without reaching the required goal, due to the lack of appreciation by the legislator and governments of the concept of the rights of this group. The thing that makes the role of the constitutional judiciary the most important and supreme because of its role in interpreting constitutional provisions and control over legislation. Which, in return, has called upon us to discuss and present this issue, through clarifying the role of the constitutional judiciary in protecting people with disabilities, specifically in the Hashemite Kingdom of Jordan as a special case. For what applies to the role of the Constitutional Court in Jordan in this field, applies as well to the role of the comparative constitutional judiciary in various aspects. Yet, without denying the role of the ordinary judiciary, in the judgments and regulations it has taken that have contributed to the protection of this category of society, whether at the level of the regular judiciary, or the religious or special judiciary.
